Reviewing Legal Agreement

This General Service Terms and Conditions outlines the terms and conditions under which On Point Notary Services LLC provides general notary, loan signing, apostille, I-9 verification, and remote online notarization services. By engaging any of these services, you (“Client”) agree to the terms set forth below.

1. Scope of Services

On Point Notary Services LLC offers the following professional services:

  1. General Notary Services: Including Acknowledgments, Jurats, Oaths/Affirmations, Copy Certifications, and other traditional notary acts. (Note: Specific exclusions may apply, such as certain documents not being eligible for notarization.)

  2. Loan Signing Services: Facilitating the execution of real estate and loan documents. (Note: Services may be limited to specific types of loans.)

  3. Apostille and Authentication Services: Managing document preparation, submission, and retrieval for state, federal, and embassy-level authentication.

  4. I-9 Employment Eligibility Verification: Acting as an authorized representative for I-9 verification on behalf of employers.

  5. Remote Online Notarization (RON): Performing notarial acts remotely through a secure online platform in accordance with applicable laws.

2. Fees and Payment Terms

  • General Notary Services: $8 per notarization ($4 per copy). A certified copy of an original document is $2. Travel and mileage fees per the IRS rate will apply ($5 + $0.70), calculated based on the distance from Rockville, Maryland.

  • Loan Signing Services: Fees are dependent on package type, distance, and additional services such as shipping and printing.

  • Apostille Services: Fees are dependent on the type of apostille/authentication required, as well as any additional services (e.g., shipping, translation). An invoice of quoted fees will be provided to the customer after booking. No refunds will be provided once the process has begun. The process is considered to have begun once On Point Notary Services LLC has submitted any documents to the appropriate authority. If canceled before any submission has been made, a full refund minus any third-party fees and $30 deposit (e.g., government fees) will be issued.

  • I-9 Verification: $50 per document.

  • Remote Online Notarization: $30 per notarization, plus any applicable platform usage fees will apply.

  • Payment Methods: Payments can be made via cash, credit card, or electronic payment methods. All fees must be paid in full before the service is rendered unless otherwise agreed in writing.

3. Turnaround Times and Scheduling

Turnaround times vary depending on the service requested. General Notary Services and I-9 Verification are usually same-day services, while Apostille Services may take several business days to weeks depending on the issuing authority. Turnaround times are estimates and not guaranteed.

4. Client Responsibilities

The Client agrees to:

  • Pay for all services before the service is rendered.

  • Provide accurate and complete documents.

  • Ensure all signers have valid, unexpired government-issued identification.

  • Review documents for accuracy before submission.

5. Cancellations and Refund Policy

Due to the nature of notary services, completed services are non-refundable. This includes but is not limited to, notarizations or notary acts that have been executed and finalized. Refunds may only be considered for advance payments if the service has not yet been provided.

5.1 Non-Refundable Deposits
Non-refundable deposits are required for all services at the time of booking. This deposit is applied to the total service fee and is not refundable under any circumstances, except if On Point Notary Services LLC cancels the appointment. 

5.2 Cancellations by Client
For General Notary, Loan Signing, I-9 Verification, and Remote Online Notarization (RON) services:

  • Cancellations made at least 24 hours in advance will receive a full refund but forfeit the non-refundable deposit.

 

5.3 Cancellations by On Point Notary Services LLC
If we must cancel for any reason, the Client will receive a full refund of any deposits or payments made including the non-refundable deposit.

 

6. Rescheduling Policy

Clients may request to reschedule an appointment. Requests to reschedule must be made at least 24 hours in advance. This policy helps ensure that we can accommodate all clients. If rescheduled, the original deposit will be applied to the new appointment. If the request is made within 24 hours, the deposit will be forfeited, and a new deposit will be required for the rescheduled appointment.

 

7. Limitation of Liability

On Point Notary Services LLC is not liable for delays caused by third parties or issues beyond our control. Maximum liability is limited to the total amount paid for the specific service.

 

8. Confidentiality

We maintain the confidentiality of all documents and information provided by the Client and will not disclose any information to third parties unless required by law.

 

9. Governing Law

This Agreement is governed by the laws of the State of Maryland. Any disputes will be resolved in Maryland District Court.

10. Severability- If any provision is found unenforceable, the remaining provisions shall continue in effect.

 

11. Amendments- This Agreement may only be amended or modified in writing and signed by both parties.

 

12. Entire Agreement- This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements.
